Terms and Conditions

1. Core Services & Contract Definition

1.1 The Agreement: By purchasing any package or booking a session at DAILYCALI, you enter into a legally binding agreement with DAILYCALI. These terms apply to all services, including but not limited to, Private Training, Group Classes (Stage 1-3), Workshops, Open Session, Park Meet Ups, and use of the studio facilities. 

1.2 Eligibility: You must be at least 18 years of age to use our services independently. Minors must have a waiver signed by a legal guardian. 

1.3 Service Scope: DAILYCALI provides calisthenics coaching and fitness guidance. We reserve the right to modify class formats or instructor assignments to maintain service quality.
 

2. Physical Training Safety & Health Declaration

2.1 Assumption of Risk: Calisthenics involves intense physical activity. By participating, you acknowledge the inherent risks of injury and voluntarily assume all such risks. 

2.2 Health Warranty: You certify that you are in good physical condition and have no medical reason or impairment that would prevent you from safely participating in training.

 2.3 Instructor Authority: For your safety, students must follow the coach’s instructions at all times. DAILYCALI reserves the right to stop a student from performing an exercise if the coach deems it unsafe.
 

3. Booking, Cancellation, and Attendance Policy

3.1 Booking Window: All class or personal training bookings must be made at least 24 hours in advance.

3.2 Rescheduling & Cancellation: You may reschedule or cancel a session up to 3 hours before the scheduled start time. 

3.3 Late Cancellation & No-Show: If you cancel with less than 3 hours' notice or fail to attend a booked session without prior notice ("No-Show"), the session will be forfeited and deducted from your package balance.
 

4. Packages, Refunds, and Validity

4.1 Validity Period: The validity of a package starts from the date of purchase. The specific expiry date is determined by the plan selected (as stated in the "Select Plans" section). Expired credits are non-refundable and cannot be extended.

4.2 Refund & Modification Policy: All sales are final. Refunds or package modifications are only permitted under the following circumstances:

  • Scenario 1: The specifically assigned coach leaves DAILYCALI.

  • Scenario 2: Permanent changes to the official class schedule that prevent the student from attending.

  • Scenario 3: A refund request made within 24 hours of the initial purchase.

4.3 Attendance Verification: Upon completion of a package, the coach will review the session records with the student for "Double Confirmation." Students must raise any discrepancies within 24 hours of this review; otherwise, the records will be deemed final and accurate.
 

5. Studio Rules & Conduct

5.1 Venue Integrity: To maintain our boutique environment in Sheung Wan, students must treat all equipment and facilities with respect.

5.2 Personal Property: DAILYCALI is not responsible for the loss or damage of any personal belongings within the studio premises.

5.3 Non-Transferability: All memberships and packages are strictly non-transferable and may only be used by the registered individual.
 

6. Content Creation & Media Rights (Portrait Rights)

6.1 Consent to Record: By agreeing to these T&C, you grant DAILYCALI permission to capture photos or videos of your training for marketing and social media purposes (e.g., Instagram Reels, Vlogs).

6.2 Opt-Out Option: We respect your privacy. If you do not wish to be featured in our content, please notify us in writing or inform our staff. We will strictly honor your request and ensure your image is not used.
 

7. Pricing & Legal Protection

7.1 Right to Adjust Pricing: DAILYCALI reserves the right to adjust service prices. Existing active packages will not be affected by price increases until the next purchase.

7.2 Limitation of Liability: To the maximum extent permitted by law, DAILYCALI, its directors, and coaches shall not be liable for any direct or indirect injuries, losses, or damages arising from the use of our services or facilities.

7.3 Indemnification: You agree to indemnify DAILYCALI against any claims or legal fees resulting from your breach of these terms or negligent behavior.
